1. Terms and conditions of services
The terms and conditions govern your use of ParkSimple’s services and their platforms for each transaction. You agree for use of the services between you and ParkSimple and/or through a third-party website or app.
In this agreement, the following terms have the meanings indicated below:
ParkSimple – the provider of parking management, services and solutions
Facilities Operator – The operator of the parking platforms that support ParkSimple with the ParkPayGo and Virtual Permit services.
ParkPayGo – the name of the product provided by ParkSimple as a web-based parking tariff payment platform.
Parking Tariff – can be advertised on signage, web link or via a QR code to which the user agrees to pay the applicable tariff for the correct duration of parking.
Payment Information – Payment method accepted by ParkPayGo now and in the future for any transaction that requires information of any payments by credit cards, debit cards, and web purchases and/or any other payment methods.
Parking Session – The period of parking you obtain from the service provider for the transaction made. The location, vehicle registration mark, start and end time of the parking session are requirements usually linked to a payment.
Transactions – When you start, pay for, complete or make a parking session transaction using the ParkPayGo service.
Transaction Entity – The various payment processing companies that assist with your transaction.
Website – in which the ParkPayGo platform is held, and users will access to make payment which may be provided the Facilities Operator.
Virtual Permit – the provision and facilitation of a virtual e-permit to park.
Virtual Permit Account – the account via an online portal which is verified for the user and where the user can login to access their account and add/remove vehicle registrations.
Intellectual Property – Publicity and proprietary rights, marks, methods of works, authorship and all other intellectual property rights related to products and services.
Terms and Conditions – As accepted and agreed by you when using the services.
2. Virtual permit options
We provide virtual permit solutions where customers can purchase different varieties of e-permit to authorise their right to park. There are different options depending on the size, type, location and parking rights of users to the car park and can either be provided in a single account or a combination of depending on the virtual permit services available in each location.
3. Applying for a virtual permit account
As the user it is your responsibility to make an application for a virtual permit account. Personal information will be requested to make your application and be approved by the ParkSimple permit team. In most cases, only one virtual permit account will be approved either per user or per address unless expressly specified and communicated otherwise.
Information requested will include name, postal address, email address and site location. In addition, a copy of a verified document will also be requested, and this can include one or more of the following: V5 document, vehicle insurance certificate, utility bill (dated in the last 3 months), tenancy document or/and any other information required to verify the applicant, the application and to approve the account.
We aim to provide a swift service so when making an application for a virtual account it is expected a response will be provided to approve or decline the application within 2 working days.
4. Virtual permit pricing
Prices for all virtual products may vary depending on the arrangements made between ParkSimple and their instructing clients. From time to time, the service provider may waiver any charges or provide applicable discounts depending on the agreement set in place. Communication to the user about any pricing changes or updates maybe provided either in writing or oral and will be effective immediately upon this communication being sent.
5. Pricing, payments and refunds
Pricing
You are responsible for payment of the advertised parking tariff, charge or tax relating to use of the services.
You are subject to the applicable terms and conditions and other requirements of any provider of the payment relating to the payment method and we have no liability for any transaction fees, insufficient funds or any other charges that is assessed by a payment provider in connection with your use of payment to the provider for transactions.
Parking tariffs may vary and be affected by such conditions as location, time of day, special events, day of the week etc. and may be beyond our control. We aim to update the payment platform and advertised parking tariff rates to any changes that are made in a timely manner.
You are solely responsible for any Parking Charge Notices or Penalty Charge Notices should the advertised terms of parking on site not be adhered to which may relate to but not limited to non-payment of the parking tariff, overstaying the paid parking session or parking in an area or location not permitted for parking.
Data usage, texting, per-minute charges, roaming and other telecom or access charges to your mobile device are your sole responsibility and acknowledge such fees and charges may apply.
A chargeback fee may be assessed if any attempt to charge your selected payment method is rejected for insufficient funds, for cancellation of your payment method or otherwise.
Payments
Payment shall be made in the currency of the country where the parking facility is located and will be made to ParkSimple or through our associated Facilities Operator. The amount includes the price specified by the Facilities Operator and any applicable service charge for the ParkPayGo services, taxes that may apply and will be charged to the selected payment method.
Refunds
If you consider there has been a billing or account error, please contact info@parksimple.co.uk. If the error in payment was made by the Facilities Operator and you are entitled to a refund via the original payment method the parking transaction was made. Both ParkSimple and the Facilities Operator will not provide cash refunds.
6. Transaction verification and failure to complete
Details of you transaction(s) will be available in real time and a receipt will be provided for the purchase of any parking session.
By using the service, you understand that this does not guarantee you a parking space. It is advised a parking space is found prior to using the service to make a parking tariff transaction. You understand that you are responsible for properly purchasing the parking session for the correct location before leaving your vehicle.
Entering correct and relevant information including vehicle registration mark, parking location and payment method you agree to and acknowledge this as your sole responsibility. You may, from time to time, when using the service, choose to receive an SMS to advise of the expiration of your parking session to re-book further session(s), if so applicable and available, and that there may be additional charges for using this service.
ParkSimple and the Facilities Operator do not accept any liability to complete any transaction which cannot be verified by the payment processing back office, whether for insufficient funds or incorrect information being provided when making the transaction via the chosen payment method.
7. ParkPayGo payment service
The ParkPayGo service is to enable payment for parking only. ParkSimple does not own, operate or maintain the car park or land to which it is contracted and is not responsible for any surfaces, boundaries, lighting or such, or any enforcement operation as may be imposed on such premises.
The parking facilitation can be operated by companies that may be associated with ParkSimple but not directly involved with the day-to-day operations of each company. Thus, you are responsible for adhering to the advertised terms and conditions of parking on the premises and this will take precedent and ParkSimple will not be responsible for any incorrect parking restrictions that are advertised on enforcement signage located through the restricted areas.
8. Season parking permits
We may provide our customers with the opportunity to purchase season permits dependent on the location and available options to pay and park. The season permits can be purchased from the Facilities Operator or associated partners as offered on the ParkPayGo platform or any other notices as such given or provided in the location. A season permit will serve as an official purchase of a sale effective to the agreement of use of the season permits terms and conditions.
Season permit prices and availability can be determined by ParkSimple or any of its associated clients. You understand if you purchase a season permit through ParkPayGo, you are subject to the same restrictions of parking in the location.
9. Disclosure to third parties
We may disclose information provided by and about you to third parties, subject to any privacy laws or regulations to:
- Our affiliates and payment companies whom we have relationships.
- In response to any summons, court or administrative order or other legal process which required our compliance.
- In compliance with any agreement between us and a professional, regulatory or disciplinary board.
- To selected service and merchant providers offering our service to help meet your needs.
- As provided and presented in our Terms and Conditions and Privacy Policy.
10. Business days and hours
Our business hours are 9.00am-5.00pm Monday through Friday except weekends and statutory bank holidays.
11. Liability, warranties and indemnifications
Liability
By using the services, you release and discharge and give up all claims which you may have against ParkSimple which relate or are connected to use of our services.
This includes any claim now or in future under common or civil law, ParkSimple policies and procedures and/or local statues or regulations. Certain laws do not allow for limitations on implied warranties or exclusion of certain damages. If these laws and disclaimers, exclusions or limitations apply to you, you may have additional rights.
Warranties
You understand that our service is provided on an available basis. You expressly agree thar your use of the service is at your sole risk. You also agree that any data, content and information provided via the ParkPayGo service platform and/or the virtual permit account is obtained and retained in line with our Privacy Policy (add link). ParkSimple makes no representations or warranties of any kind, express or so implied.
ParkSimple and, or the Facilities Operator does not own, control or operate the parking facility and will not be responsible for any loss or damage howsoever, caused relating to its parking operator including direct, indirect, incidental and consequential damages arising to your vehicle, loss of your vehicle, or loss of belongings left in your vehicle or personal injury.
ParkSimple, and, or the Facilities Operator is not responsible for any Parking Charge Notices or Penalty Charge Notices you receive even if the services were used in connection with a transaction or through your virtual permit account. You are solely responsible for any appeal or payment for said notices with the parking operator appointed on the site. We do not enforce parking restrictions and have no liability or control of third parties who provide enforcement services to the site.
Indemnification
You agree to indemnify and hold harmless ParkSimple with respect to any liability, damages, claim, debt, demand, cause of action costs or expenses arising from a third-party claim against ParkSimple relating to unlawful use of the services; misconduct or any breach of representations, violation of law; infringement of intellectual property or proprietary rights of any person or entity; warranties or covenants made and failure to comply with these terms and conditions.
12. Miscellaneous
You may not assign, transfer or sublicense this agreement without ParkSimple’s express written consent. We may transfer our rights under this agreement at any time. We do not give up our rights by failing or delaying exercising them at any time.
If we take legal action against you because of any material breach of the terms of this agreement, you must pay all reasonable fees and costs of any legal proceedings. If for any reason, it is found by a court to be illegal or not enforceable, all other terms will still be in effect.
You acknowledge and agree that these terms, the Privacy Policy (add link) and Cookies Policy (add link), and where applicable any stored personal data, constitutes the entire agreement of the parties relating to the subject matter. Any prior agreements concerning the subject matter, whether written or oral, are hereby superseded and terminated in their entirety and are of no further effect.
Some pages on our website include links to third part websites. These are governed by their own privacy statements, and we are not responsible for their operations or practices. You should review the privacy statement of any third-party websites before providing any personal information.
From time to time, we may change or updates these terms and conditions, privacy policy (add link) and Cookies policy (add link) or any of our services at any time. Notification of changes in the manner applicable by law prior to the effective date of the change and if any notification is required to you by this law.
13. Intellectual property
All intellectual property pertaining to and provided by ParkSimple in any format in which it is so presented to include but not just limited to website, app, signage, emails, pictures, videos or any other medium for its services and solutions remain the sole property of ParkSimple and our affiliates or other service providers and representatives together with any good will, enhancements, new versions, changes and updates of our intellectual property.
ParkSimple does not grant to you or any other third parties any express or implied ownership or other rights to any intellectual property and all such rights are retained by ParkSimple. For any such infringement you are liable for all damages.
